I have fred loya and my 17 year old was driving my car wich is insured under my name.I have full coverage, now when the accident happened was when a pissed off driver cut infront of her and slammed the brakes.There wasnt any stop signs no traffic lights just road.Well she ended up hitting the pissed off driver.Now my insurance wants me to add my 17 year old to the policy and they want me to pay $250 to add her to the policy, they stated if i dont they will cancel my insurance also keep in mind that she doesnt have a license at all.
Is this normal on the Insurance Laws or am i being ripped off.

thats ridculous you should'nt even be complaining the point is she doesnt have a driver license. She should'nt be driving in the first place. Next you should'nt let her drive. Isn't that easier.

Fred Loya is a non standard insurance carrier they offer county mutual insurance policies. The rules for them are different than for a standard company such as State Farm or Allstate. When you first purchased your policy they probably asked you if there were any other people who drove your vehicle other then those listed on the policy. And your answere was porbably no or they would have asked you to exlude them. So because of that yes they can deny you claim and then request you to add her to your policy as either an insured driver or an exluded driver. That is leagel acording to the Texas Board of Insurance. I agree that there needs to be insurance reforme in Texas but untill then the consumer will continue to get lawfully screwed by insurance companies.

I'm amazed that you are complaining about your Insurance company not wanting to cover someone without a DL. You are aware that you must have a DL to operate a motor vehicle in the State of Texas, so by allowing an unlicensed driver to use your car is a valid reason for cancelling your policy. Was your child cited for not having a license, by the way?

yes they can deny the claim if she is not on the policy w/u and keep in mind insurance companies have a driver exclusion form..

In Texas, if she is unlicensed, then she should be covered under your policy without additional charges. When my kid had her permit, she was covered under my policy without additional premiums until she received her actualy license. I then was required to add her to my policy.
The fact that she is not licensed is not relevant in this matter.
Talk to a bad faith lawyer and see what your rights are. You may in fact have a claim against the carrier for bad faith, fraud, etc.

If he wasnt your child, would you preffer to be hit by a no license/no insurance driver or by a no license but with insurance driver???
